We have some good news to report for a change. Thanks to some hard work and having a lobbyist who knows who to talk to, Bob Levy and Mike Compton were able to convince enough folks that this was a bad bill for homeowners.
SB 2270 & HB 1523 were bills being considered for Nonjudicial foreclosure on individual's homes. The bills would have allowed banks to foreclose without going through the court system, preventing due process. This would have eliminated the need for a process server to serve any of the foreclosure papers in the State of Florida. Basically, the banks would have sent a letter or a telephone call saying they were foreclosing and would not use the court system. No court filing, no process of summons and complaints, therefore NO PROCESS SERVER needed.
Once again, a big Thank You to our lobbyist Bob Levy, for "keeping his ear to the ground" for FAPPS, and to Mike Compton for putting in the time with Bob to talk to enough folks and make enough sensible arguments to help stop this bill. Bottom line, if this bill had passed it would have cost many Process Servers thousands or perhaps millions of real dollars, in addition to depriving homeowners of an important right, the right to due process.
