May 2008 Legislative Update

The legislative session ended May 2nd, 2008 and the bill we were working on with the Sheriffs did not make it. Although we made our case successfully to the Governor's staff and had their blessings, the Governor waited until late in the afternoon on Monday April 28th to advise that he would not veto. Our lobbyist then worked on getting it through the House where it was stalled because of the Governor's indecision. It eventually passed, on Friday May 2nd, but with an amendment. The Senate was not able to reconcile the House version with the already passed Senate version Friday afternoon. Our lobbyist believes that since we finally have the Governor on our side, next year should be successful.

FAPPS has spent a lot of money and time on this effort. Jack Lippman and Mike Compton deserve a lot of credit for their efforts, including several last minute trips to meet with folks in Tallahassee. Although the effort "failed" this year, I do not believe it was wasted. I believe we have set ourselves up for success next year.

Service of Process [LPCC]; Increases the fees charged by the sheriff in civil cases for service of process from $20 to $40. Deletes a prohibition on additional fees for alias and pluries documents when service was not effected on the original document in the county of original request by that sheriff. Provides that criminal witness subpoenas and criminal summonses may be served by a special process server appointed by the local sheriff or by a certified process server, etc.  EFFECTIVE DATE: 07/01/2008.
